Terms & Conditions

This auction will not have sales tax, but will have 10% Buyer's Premium Added to each winning invoice.

GENERAL:

All items are sold AS IS, WHERE IS with no warranties or guarantees.

Metzger Property Services accepts preview requests for further inspection of item(s) prior to bidding. If you are inspecting a vehicle or motorized item, Metzger Property Services only allows the item to be started to hear it run or operate -- it is NOT allowed to be driven.

All auctions are a soft close, unless otherwise listed, meaning that the auction does not end until all bids are completed. Lots close out 1 at a time. There is a countdown on the lots to let you know how much time remains on each lot. If any bidding happens in the last 2 minutes of the lot ending, the time does extend another 2 minutes. It is highly recommended that you are in the auction watching the lots close, not in your watchlist.

Metzger Property Services reserves the right to reopen an auction or bid if there are technical difficulties, to allow for fair bidding. Previous winning bids may no longer be valid in this situation.

Metzger Property Services reserves the right to use stock images for products. Products may not come assembled as shown in stock image. Buyers are responsible for reviewing all photos listed and/or scheduling a preview.

Once a bid has been placed and confirmed, it cannot be retracted. By placing a bid, the buyer agrees bid retraction is disruptive and interferes with the auction.

Payment is due the day following the auction at the scheduled pick up, unless otherwise stated on the auction. Metzger Property Services is not responsible for checking accounts for updated information including but not limited to addresses, phone numbers, valid credit cards, email addresses, etc.

Buyer accepts the terms by entering and bidding in the auction and recognizes that items are to be forfeited 5 days following the auction and that he or she is still responsible for all costs due regardless of the item(s) still being available. 

All auction end times and loadouts posted are in Eastern Standard Time, unless otherwise noted.


PAYMENT TYPES & FEES:

Valid Credit Card required for bidding approval. All bidding is in US Dollars (USD). You may pay with Cash, Check, Certified Check, Credit or Debit Card with 4% convenience fee, or Wire Transfer ($25 fee added to each Wire); If you pick your winnings up at our specified time and location for the auction listed above. There is a $5 minimum if you would like to pay with a Card. Any invoices paid with a card that are less than $5 will be rounded up to meet the minimum requirement.

For out of state buyers with an invoice total of $500.00 or greater, we reserve the right to ask that funds be in a certified form with either a Certified Check, Money Order or Wire Transfer ($25 fee added to each Wire). If you are an out of state buyer and are sending a freight driver, payments must be received by wire only prior to pick up.

Metzger Property Services reserves the right to request signed documentation stating a buyer will not issue a chargeback for a credit card payment or a stop payment for a check.

Metzger Property Services reserves the right to charge sales tax on each winning invoice. If you are Tax Exempt, please have your exemption form or the information you will need to fill one out ready at checkout! We do require an Indiana ST-105, a merchant certificate will not be accepted. We need a new one each calendar year on file, so plan accordingly. This is available in the documents tab of each auction.

Metzger Property Services reserves the right to charge a buyer’s premium to be added to each winning invoice.

Refunds will not be issued for payment type changes. Please make sure the correct card is on file that you would like charged.

If you request a refund and it is approved, only the bid amount and tax will be refunded when applicable. The buyer’s premium will not be refunded. If the invoice was originally paid for with a credit card, the 4% fee will NOT be included in the refund. All refunds will be sent via mail to the address we have on file – buyers are responsible for updating address. No partial refunds will be issued and credits will not be offered. To receive a refund, all items must be returned.

All titled items will have a $25 Title Administration Fee. It is the buyer’s responsibility to notify us if the address you registered with is different than the one you want the title mailed to. All titles are mailed signature required – no exceptions. Metzger Property Services reserves the right to hold any titles for items paid with check or card for 10 business days.

If you do not come to the load out time specified on the auction, a $10.70 handling fee will be added to your invoice and your card on file will be charged for your purchase total plus the 4% credit card service fee.

Habitual Offenders: If a buyer habitually fails to pick up their items during the allotted time, a $53.50 late fee will be assessed on the invoice for the third late pick up within 30 days and every late pick-up after that.

  • For any account with habitual fees. Metzger Property Services reserves the right to apply these to any account in the same household.

If the card on file declines, a $5.00 declined card fee will be added, and the buyer will be blocked until payment is received. If a buyer provides a prepaid card as the default on their account, they are responsible for making funds available to avoid extra fees.

If your card habitually declines more than once within a 30-day period, Metzger Property Services reserves the right assess a $50.00 declined card fee for the current invoice, and each invoice following. Your balance due must be $0.00 before your account will be reinstated.

If a check is returned for any reason, a $25 returned check fee will be added to the amount of the original invoice, the buyer’s account will be blocked and the invoice must be paid with cash, cashier’s check or wire before the account will be reinstated.

If you continue to not pay for your items, at the end of each month there will be a 2% interest charge per calendar month (24% per annum) with a $10.00 minimum on each late invoice. There will be an additional $100.00 collection fee added the following calendar month of purchase.


If a buyer has outstanding balances not taken care of, Metzger Property Services, LLC reserves the right to take legal action. Should that occur, the buyer is responsible for the invoice plus all fees associated with the legal process including but not limited to attorney’s fees, filing fees, court costs, interest, and late fees.

Metzger Property Services reserves the right to ban a bidder for non-payment, non-compliance, and/or habitual issues.


PICK-UP, TRANSPORT &/OR SHIPPING:

Pickup will be the following day by appointment only! Your winning invoice will be emailed to you -- pickup information and exact loadout times will be included in the body of that email through a hyperlink to www.signupgenius.com, where you can also book a pickup time slot! ** If you do not receive an email, please check your junk/spam mail! Buyer is required to bring their own packaging, help to load and/or equipment for loading unless otherwise stated on the auction.

Metzger Property Services reserves the right to obtain a signature verifying that all purchased items are received at the loadout. By signing their invoice, a buyer or any party they send to pick up for them, agrees that they have checked all lots and are accepting the items in AS IS Condition. Once the invoice is signed, Metzger Property Services is not responsible for missing items or the condition of items. No refunds will be issued after the loadout for missing items. If a buyer has any issues during a loadout, they must be addressed with the cashier present before signing an invoice for action to be taken.

Any other potential refunds will be sent to the accounting department for further review.

If Metzger Property Services is to transport your item(s), there will be a minimum $20 service fee added to your invoice. We will only transport your item(s) if feasible for us, this is not guaranteed, and you should place bids accordingly. The fee will be assessed by the loadout staff if items are to be removed from the auction site the day of the loadout.

Items not picked up within 5 days will be resold at new owners’ expense, even if paid for. Items not paid for after 5 days will be resold. Buyer is still responsible for paying outstanding invoices before being reinstated to bid.

Shipping is available on small lots. Buyer is responsible for notifying Metzger Property Services of any shipping requests. Metzger Property Services does not assume shipping, even for out of state buyers.

Metzger Property Services reserves the right to include charges for insurance for shipping on invoices more than $100. Any fees will be included in the total shipping costs added to the invoice.

Buyer is responsible for paying for items in full prior to being allowed to pick-up or have items shipped. Shipping costs include the cost of shipping plus up to a $10.70 handling fee per invoice. If a bidder has multiple invoices within a 7-day time frame, items can be shipped together upon request to minimize shipping costs.

Buyer is responsible for all shipping/handling charges incurred including fees charged by delivery service for incorrect addresses. If items are returned to Metzger Property Services due to incorrect shipping address, Metzger Property Services reserves the right to not reship, or charge for the reshipment of the items.

At our discretion, shippable items may go to the UPS store. This may result in higher shipping costs. The UPS Store will reach out to you directly to collect payment. Metzger’s will only collect the handling fee in this case, but you will pay UPS directly for the shipping costs. Exceptions may apply. 


Metzger Property Services LLC is not responsible for the loading out of items. Any load-out services are provided as a courtesy and Metzger Property Services assumes no responsibility or liability for damages to said items or injuries to persons as a result of helping with the pick-up and/or loading of merchandise. Owners, original or new, assume all responsibility and liability during the loadout process. By Bidding and/or Consigning, buyers & sellers both waive any claims to personal injury or property damage resulting from the buyer/sellers request for courtesy loading assistance. Buyers and Sellers are welcome to load their own items with their own equipment, at their own risk.
